Mediation and Arbitration The court process can be lengthy, expensive, and sometimes unsatisfactory to one or more parties, and Alberta has advanced legislation to allow parties to voluntarily enter in a mediation process in attempts to resolve issues by negotiation assisted by trained mediators. Should mediation fail to resolve some or all issues, the mediator may be empowered to determine issues as an arbitrator should the parties so contract. Wills, Enduring Powers of Attorney and Personal Directives Everyone should consider having a valid Will to ensure that your estate is dealt with in the way you want it. A Will also ensures that your wishes can be dealt with promptly by a named Executor. Two other documents that everyone should consider having drafting are the Enduring Power of Attorney and Personal Directive. These documents come into play if and/or when you become mentally incapable of making decisions. An Enduring Power of Attorney names someone to deal with your financial matters and a Personal Directive is a “Living Will” and provides for someone to deal with your personal decisions should you lose the ability to make these decisions.
